Be it ordained by the City Council, in session assembled, that Chapter 6 of the Code of Ordinances of the City of Somerville is amended as follows by adding the following Article:
ARTICLE VIII. RODENT CONTROL
Sec. 6-105. - Use of anticoagulant rodenticides prohibited.
The city, its agents, employees, or contractors, may not use First Generation Anticoagulant Rodenticides (FGARs), including products containing warfarin, chlorophacinone, or diphacinone, or Second Generation Anticoagulant Rodenticides (SGARs), including products containing brodifacoum, bromadiolone, difenacoum, or difenthialone, which interfere with blood clotting and cause death from excessive bleeding, on city-owned property.
Sec. 6-106. - Waiver.
The Division of Public Health may grant an emergency waiver for the use of FGARs or SGARs on city-owned property. (1) The Division of Public Health may not grant a waiver unless the requestor demonstrates the existence of a significant rodent infestation that poses a significant public health risk, they have exhausted all other viable methods to control it, and those other methods have been ineffective.
(2) The Division of Public Health shall include duration and location restrictions and a list of products authorized for use to control the infestation in the waiver.
The Division of Public Health shall publish and submit to the Board of Health an approved waiver.
