To the Honorable Board:

I write in response to Agenda Item #203248: "That the City Solicitor and Director of Inspectional Services review the Chicken & Rice Guys license for the number of trucks allowed and the idling time allowed, and advise the Board of its findings."

I have reviewed The Chicken & Rice Guys special permit and Board of Health license with the Director of Inspectional Services.  There are no limitations on the number of trucks allowed. The idling time allowed, while not referenced in the license, is prescribed by state law.  Pursuant to G. L. c. 90, section 16A, unless engine assisted power is necessary and substitute alternate means cannot be made available, idling time shall not exceed five minutes.
