To the Honorable Board:

 

We understand that tonight the mayor will present the development covenant he has negotiated with US2. We urge you to ask questions about the covenant.

                     If the zoning is not approved by 5/31, will the covenant be invalidated? If that happens, will the MLDA also be invalidated?

                     Why has there been no opportunity for public input on the covenant?

We believe the BOA should ask the mayor to wait to sign the covenant until you have had a chance to read it thoroughly and propose changes.

                     The covenant depends on the zoning being approved as is, even though members of the neighborhood council working group and others have requested changes to the zoning.

                     The community benefits committee ordinance says that all developer contributions will be overseen by a City-appointed committee, so there may not be additional money for CBA negotiations.

                     Some of the future contributions for community benefits can be diverted to GLX and infrastructure at the discretion of the mayor.

                     This has just been released and there has been no opportunity for the public to discuss or influence it.

We look forward to working with the BOA to clarify this process and improve the community benefits committee ordinance.
