To the Honorable Board:

I respectfully request your approval of an Order of Taking to clear title to Kensington Avenue to establish that the City owns the underlying land in fee simple. 

The City took this land in 1927 but the Order of Taking did not establish whether the City took it in fee or by easement.  It is essential to the long term traffic planning in Assembly Square that the City owns the property in fee. 

Normally, this matter would not be of any urgency, but it is also important to close a loan on the development being constructed at Middlesex Avenue that the City's ownership of the adjacent Kensington Avenue be in fees simple.  I therefore request you to take prompt action on this matter at your meeting on July 12, 2012.
