Dear Honorable Board Members:

Enclosed is tracked and clean version of Traffic Safety Zone Home Rule Petition, as approved by Legislative Matters Committee on April 7, 2016.

At the meeting, Alderman Ballantyne asked whether the phrase “adjacent to a park or playground” includes parks and playgrounds within a school zone. In my opinion, the phrase does include school zones. However, the adoption of Traffic Regulations set forth in the Home Rule Petition is permissive. Furthermore, although the phrase includes school zones, Massachusetts Law already provides that the speed limit is 20 miles per hour within school zones. (G. L. c. 90, § 17).
