To the Honorable Board:

 I respectfully request that your Honorable Board vote to rescind acceptance of Mayors request #199464 and approve authority to refund the Millbrook Stabilization funds back to Berkeley Investments Inc., In order to satisfy the conditions of ZBA decision 2013-89 condition #19. 

This project was originally planned as part of a 2013 Street Reconstruction Contract.  Approval from the MBTA was not obtained by the developer until October 2014 which would have pushed this work to the 2015 construction season.  Material and labor costs associated with the work had escalated by that time.  Developer is able to obtain better pricing by using their own (MBTA approved) contractor.
