Requesting acceptance of two easements over DCR land in Assembly Square.

To the Honorable City Council:
I respectfully request that this Honorable City Council consider and accept easements over land owned by the Department of Conservation and Recreation ("DCR") in Assembly Square. The first easement gives the City an easement for Great River Road and the Shared Use Path, while the second grants the City a drainage easement for Infiltration and Inflow purposes.
Conveyance of the easements was one of the conditions of an Art. 97 land swap between Assembly Square developer Federal Realty Investment Trust ("FRIT") and DCR. The monetary consideration stated in the easement deeds is the value of in kind work already performed by FRIT; DCR requires no payment from the City for the easements.
The easements were to have been granted by the state and accepted by the City in 2011. Plans showing the easements have been recorded; however, the easement documents were never executed. This oversight was discovered in connection with the due diligence undertaken for the recent closing of FRIT's I-Cubed bonding.
I have attached both easements and their corresponding recorded plans.
