To the Honorable City Council:

 

The Mayor respectfully requests that this Council consider and accept a deed, maintenance license and maintenance easement as follows:

 

                     1)                      A deed from BOYTON YARDS LANDCO, LLC conveying Civic Space 1 (located between 101 South Street and 808 Windsor Street) to the City; and

 

                     2)                      Grant a maintenance license to the BOYTON YARDS OWNERS' ASSOCIATION, its successors and assigns (“the Association”) to permit and require the Association to maintain Civic Space 1 in perpetuity, retaining a covenant running with the land of 808 Windsor Street to be enforced by the City against the owner of 808 Windsor Street if the Association is dissolved; and

 

                     3)                     Grant a drainage maintenance easement over, under and across Civic Space 1 to SILICON PROPCO 2021, LLC (owner of 101 South Street) and BUILDING 2 OWNER LLC (owner of 808 Windsor), to install, construct, maintain, operate and use their respective Drainage Facilities (as defined in the easement) located underneath the Civic Space 1 including access needed to repair damage if any to Civic Space 1 resulting from the operation and maintenance Drainage Facilities as further described in the easement document.
